The Meeting of the WG4 on “Reduction of informal unemployment and remuneration” within the Economic Council to the Prime Minister of the Republic of Moldova was held on 3 February 2022.
According to the Agenda, the following topics related to remote work were discussed:
1. General subjects related to remote work (for non-resident foreign citizens , for non-resident citizens of RM, for citizens of RM resident in RM):
✅Extending the possibility to formalize employment relationships without a qualified advanced electronic signature. At the moment it is allowed to sign employment contracts only with qualified advanced signatures.
✅Reduction of liability for Occupational Health and Safety.
✅Payment of salary in foreign currency (for those who work remotely and allow the establishment of remuneration in foreign currency)
2. Remote contracting / employment of foreign nationals:
📌 Service contracts
✅exclusion of the obligation to have signed delivery notes
✅consideration of VAT and its refund (for resident companies it would be more convenient to operate through individual employment agreements).
✅ withholding or not withholding tax (presentation of residence certificate or identity document as appropriate).
📌Individual employment agreements:
✅ payment of social and medical contributions (method, institution, reference criterion)
✅ reporting to foreign nationals
3. Flexibility of labor relations
✅ Conclusion of fixed-term employment agreements
✅ Dispersion of 28 calendar days or 20 working days leave (equivalent to 28 calendar days), calculation formula for holiday allowance
✅ Obligation to require employees to take the annual leave, one of the installments mandatory having at least 14 days
✅ Payment of the annual leave allowance together with the salary
